Terms of Use
These Terms of Use (hereinafter referred to as “Terms”) stipulate the terms and conditions for using the services provided by VIVALDI on this website (hereinafter referred to as ‘Services’). Registered users (hereinafter referred to as “Users”) shall use the Services in accordance with these Terms and after agreeing to VIVALDI's Privacy Policy.

Article 1 (Application)

1. These Terms shall apply to all matters related to the use of the Service between the User and VIVALDI.

6. Other cases where VIVALDI determines that registration is inappropriate
Article 3 (Management of User ID and Password)
1. Users shall manage their user IDs and passwords for this service appropriately at their own risk.
2. Under no circumstances may users transfer or lend their user IDs and passwords to third parties, or share them with third parties. VIVALDI will consider any login using a combination of user ID and password that matches the registered information to be use by the user who registered that user ID.
3. We shall not be liable for any damage caused by the use of user IDs and passwords by third parties, except in cases where VIVALDI is guilty of intentional misconduct or gross negligence.
Article 4 (Usage Fees and Payment Methods)
Users shall pay the usage fees separately determined by VIVALDI and displayed on this website as consideration for the paid portion of this service, using the payment method specified by VIVALDI.
Article 5 (Posting and Exhibiting)
1. Users who register for this service and post or offer items for sale shall be able to do so after registering and purchasing the posting and offering plans provided by this service.
2. Users who purchase posting and listing plans are deemed to have understood and agreed to the contents of the posting and listing plans before purchasing them.
3. If, after a user has paid the usage fee, the fee is not transferred to our company for any reason, VIVALDI shall promptly contact the user and, in some cases, shall have the right to delete the user's posts and listings.
Article 6 (Prohibited matters)
Users shall not engage in the following acts when using this service.

4. VIVALDI, other users, or other third parties' servers or networks.
5. Commercial use of information obtained through this service
6. Acts that may interfere with the operation of VIVALDI's services
7. Acts of unauthorized access or attempts thereof
8. Collecting or accumulating personal information about other users
9. Using this service for improper purposes
10. Acts that cause disadvantage, damage, or discomfort to other users of this service or other third parties.
11. Impersonating other users
12. Advertising, promotion, solicitation, or sales activities on this service that are not authorized by VIVALDI.
13. Posting or offering for sale stolen goods or items that are not owned by the individual.
14. Posting or offering for sale counterfeit goods or copy products that are falsely represented as genuine goods.
15. Posting or offering items that contain the following sexual content
(1) Content containing nudity
(2) Content that sexually gratifies, implies sexuality, or is intended to sexually stimulate
(3) Content dealing with sexual fetishism
(4) Content related to sexual entertainment
(5) Content promoting sexual products
(6) Content that encourages adultery, infidelity, or sexual activity
(7) Content that provides advice on sexual abilities
(8) Content promoting sexual enhancers and supplements
16. Posting or offering content that contains explicit sexual descriptions as described below.
(1) Content that includes sexual text, images, audio, video, and games
(2) Content that includes forced sexual acts, whether virtual or real
17. Posting or offering the following shocking content
(1) Descriptions or images that are grim, graphic, or offensive
(2) Content depicting violent acts
(3) Content that contains excessively obscene or offensive language
(4) Exceptions for gameplay images: In the context of gameplay images, content will be considered “gruesome, provocative, or repulsive depictions or images” or “depictions of violence” if it depicts the following.

(2) Content that falsely suggests an affiliation with or endorsement by a specific individual, organization, product, or service.
31. Posting unreliable and harmful statements
(1) Content that makes claims that are clearly untrue and could significantly hinder participation in and trust in the electoral and democratic process.
(2) Content that promotes claims that are harmful to health, or content that is related to a current serious health crisis and contradicts reliable scientific consensus.
(3) Content that contradicts reliable scientific consensus on climate change
32. Posting the following fraudulent acts
(1) Inducing users to view content through false representations or unclear expressions.
(2) Stealing personal information or deceiving users into providing personal information
(3) Promoting content, products, or services through false, fraudulent, or exaggerated advertising.
(4) When dealing with content related to politics, social issues, or matters of public concern, collaborating with other sites or accounts to conceal or falsify important information about one's identity or oneself.
(5) Falsifying or concealing important information about one's home country or oneself, and distributing content related to politics, social issues, or social concerns to users outside one's home country.

39. Posting or offering copyrighted content (TV programs, movies, audio files, etc.)
40. Posting or offering items for sale that violate laws and regulations
41. Posting or offering items that violate public order and morals
42. In addition, if VIVALDI determines that the use of this service is inappropriate.
43. Acts intended to meet members of the opposite sex whom one does not know
44. Acts that directly or indirectly provide benefits to anti-social forces in connection with VIVALDI's services.
45. Other acts deemed inappropriate by VIVALDI
Article 7 (Suspension of provision of the Service, etc.)
1. VIVALDI may suspend or interrupt the provision of all or part of the Service without prior notice to users if it determines that any of the following circumstances apply.
(1) When performing maintenance, inspection, or updates on the computer system related to this service
(2) When it becomes difficult to provide this service due to force majeure such as earthquakes, lightning strikes, fires, power outages, or natural disasters.
(3) In the event of a computer or communication line failure due to an accident

2. VIVALDI shall not be liable for any disadvantage or damage suffered by users or third parties as a result of the suspension or interruption of this service.
Article 8 (Restrictions on Use and Cancellation of Registration)
1. VIVALDI may, without prior notice, restrict the use of all or part of the Service or cancel the registration of a user if the user falls under any of the following categories.

2. VIVALDI shall not be liable for any damage caused to users by actions taken by the Company based on this article.
Article 9 (Disclaimer of Warranties and Disclaimers)
1. VIVALDI does not expressly or implicitly guarantee that this service is free from factual or legal defects (including defects, errors, bugs, or infringements related to safety, reliability, accuracy, completeness, validity, suitability for specific purposes, security, etc.).
2. VIVALDI shall not be liable for any damages incurred by users arising from this service, except in cases of willful misconduct or gross negligence on the part of VIVALDI. 3. Even in the cases specified in the proviso to the preceding paragraph, VIVALDI shall not be liable for any damages incurred by the user as a result of VIVALDI's negligence (excluding gross negligence) or tortious conduct, including damages arising from special circumstances (including cases where VIVALDI or the user foresaw or could have foreseen the occurrence of such damages). Furthermore, compensation for damages incurred by the user as a result of VIVALDI's breach of contract or tortious act due to negligence (excluding gross negligence) shall be limited to the amount of usage fees received from the user in the month in which the damage occurred. VIVALDI shall compensate the user by providing a coupon issued by the company that allows the user to purchase the listing/posting plan they purchased for free.
4. VIVALDI shall not be liable for any transactions, communications, or disputes arising between users and other users or third parties in connection with this service.
5. VIVALDI shall not be liable for any damages or other issues that may arise between users who have listed items for sale and users who have purchased or received items through transfer due to communication failures.
6. VIVALDI shall not be liable for any damage or other issues arising between users who have listed items for sale and users who have purchased or received items through transfer due to problems on the part of the server provider contracted by VIVALDI that interfere with VIVALDI's services.
7. VIVALDI shall not be liable for any damages or other problems arising from the use of payment methods provided by third parties for trading transactions referenced on this website.
8. VIVALDI shall not be liable for any charges incurred by users or subscribers from their telecommunications carriers as a result of using this website (listing or viewing items).
Article 10 (Claims for Damages)
If a user causes damage to VIVALDI by violating these Terms of Use or by using the Service in an improper or illegal manner, VIVALDI may seek compensation for damages (including attorney's fees) from the user.
Article 11 (Changes to Service Content, etc.)
VIVALDI may change, add, or discontinue the contents of this service with prior notice to users, and users shall agree to this.
Article 12 (Changes to Terms of Use)
1. VIVALDI may amend these Terms without requiring the individual consent of users in the following cases.

Article 13 (Handling of Personal Information)
VIVALDI will handle personal information obtained through the use of this service appropriately in accordance with VIVALDI's Privacy Policy.
Article 14 (Termination of the Service)
1. VIVALDI may terminate all or part of the Service for users after giving prior notice to users within a certain period of time.
2. The notification described in the preceding paragraph shall be sent to users registered with the Service via email.
3. If VIVALDI terminates the Service after notifying users in accordance with the method described in Paragraph 1, VIVALDI shall not be liable for any damages, losses, or other expenses incurred by registered users of the Service as a result of the termination of the Service.
Article 15 (Notification or Contact)
Notifications or communications between users and VIVALDI shall be made in accordance with the methods specified by VIVALDI. Unless VIVALDI receives a notification of change from the user in accordance with the method specified separately by VIVALDI, VIVALDI shall deem the currently registered contact information to be valid and shall send notifications or communications to that contact information, which shall be deemed to have reached the user at the time of dispatch.
Article 16 (Prohibition of Transfer of Rights and Obligations)
Users may not transfer their status under the Terms of Use or their rights or obligations under these Terms to a third party, or use them as collateral, without the prior written consent of VIVALDI.
Article 17 (Governing Law and Jurisdiction)
1. Japanese law shall be the governing law for the interpretation of these Terms and Conditions.
2. In the event of any dispute arising in connection with this service, the courts having jurisdiction over the location of VIVALDI's head office shall have exclusive jurisdiction.
